1. Introduction

These Terms & Conditions govern the use of the Pool Perfectionists website, the purchase of products, and the provision of our services.
By placing an order or booking a service, you agree to these Terms & Conditions. Please read them carefully before proceeding.

2. Orders & Acceptance

  • All orders are subject to availability and confirmation of the order price.
  • We reserve the right to cancel or refuse an order if:
    • The product is out of stock
    • There is a pricing or description error
    • Payment cannot be processed
    • Fraudulent or suspicious activity is suspected

3. Pricing & Payment

  • All prices are in Australian dollars (AUD) and include GST unless otherwise stated.
  • We accept Visa, Mastercard, PayPal, and other payment methods displayed at checkout.
  • Prices and availability are subject to change without notice.
  • Payment must be received in full before products are shipped or services are provided.

4. Shipping & Delivery

  • Delivery times are estimates only and may be affected by external factors beyond our control.
  • Risk in the products passes to you upon delivery.
  • Damaged or missing goods must be reported within 48 hours of delivery with photo evidence.

5. Returns & Refunds

  • We comply with Australian Consumer Law regarding faulty, damaged, or incorrectly supplied products.
  • Change-of-mind returns are at our discretion and will only be accepted within 14 days, provided goods are unused, in original packaging, and in resaleable condition. We will provide an exchange voucher and we charge a 20% restocking fee.
  • Pool chemicals cannot be returned for change of mind due to safety regulations.

6. Warranties

  • Most products are covered by a manufacturer’s warranty.
  • Warranty claims require proof of purchase and may require assessment by the manufacturer.
  • Warranties do not cover:
    • Normal wear and tear
    • Damage caused by misuse, neglect, or incorrect installation
    • Consumable parts such as seals, gaskets, or filter media

7. Service Terms

  • For on-site services, you must ensure safe and reasonable access to the pool area.
  • Call-out fees may apply.
  • Cancellations with less than 24 hours’ notice may incur a cancellation fee.
  • We are not liable for pre-existing faults, damage caused by third parties, or issues arising from incorrect use of products after installation.

8. Limitation of Liability

  • To the fullest extent permitted by law, Pool Perfectionists is not liable for indirect, incidental, or consequential losses.
  • Nothing in these terms limits your rights under Australian Consumer Law.

9. Intellectual Property

  • All content on our website, including text, images, product descriptions, and logos, is the property of Pool Perfectionists or its licensors.
  • You may not reproduce, distribute, or use this content without prior written permission.

10. Website Use

  • You agree to use our website for lawful purposes only.
  • You must not attempt to disrupt, damage, or gain unauthorised access to our systems or data.

11. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of that State.
